California Privacy Policy
Effective Date: July 1, 2020
Notice for California Residents
The California Consumer Privacy Act (CCPA) gives California residents certain rights regarding their personal information. This California Privacy Notice (“Notice”) describes these rights and provides disclosures required by the CCPA regarding how CRESTICO, INC. (“CRESTICO”, “we,” “us,” or “our”) collects, uses and discloses California residents’ personal information.
CCPA Scope and Exemptions
This Notice applies to information of California residents that constitutes “personal information” under the CCPA to the extent CRESTICO handles such personal information in its capacity as a “business” under the CCPA. However, this Notice does not apply to information exempt from or otherwise not subject to the CCPA’s requirements. In certain cases, we may provide a different notice to California residents pursuant to the CCPA, in which case that notice will apply instead of this one.
CCPA Rights: The CCPA grants residents of California the rights described below. These rights are not absolute and are subject to certain exemptions, so in certain cases we may deny your requests regarding these rights as permitted by law.
Right to Know About Personal Information Collected, Disclosed, or Sold: You have the right to request the following from CRESTICO:
- A copy of the personal information we have collected about you in the preceding 12 months.
- The categories of personal information we have collected about you in the preceding 12 months.
- The business or commercial purpose for collecting and/or selling your personal information.
- The categories of sources that we used for collecting your personal information.
- The categories of your personal information that we have sold or shared for business purposes in the preceding 12 months.
- The categories of third parties to whom we sold your personal information or disclosed it for a business purpose in the preceding 12 months.
Right to Request Deletion of Personal Information: You have the right to request the deletion of your personal information collected by us.
Please understand that we cannot provide you any services that depend on personal information that we have deleted at your request.
Right to Non-Discrimination: Exercising your privacy rights under the CRESTICO California Privacy Notice will not lead to any discriminatory treatment from us in violation of the CCPA.
Right to Opt Out: You have a right to opt out from the “sale” of your personal information. We do not sell your personal information in the conventional sense, i.e., for money.
However, we may share your information in two ways that could constitute a statutory “sale” under the CCPA’s broad definition of that term:
- Like many companies, we use services that help deliver interest-based ads to you, such as the services associated with the advertising cookies described in our Privacy Policy. Our use of these services may constitute a “sale” of your personal information for purposes of the CCPA because the advertising partners that provide the services collect information from our users (e.g., the device data and online activity data described above) to help them serve ads more likely to interest them.
- When you direct us to share your personal information with our partners to obtain offers for financial products and services, those partners reserve the right to use and disclose your personal information as described in their privacy policies.
For more information or to opt out of any future sharing of your information for the purposes above by emailing privacy@crestico.com.
Authorized Agent: Your authorized agent may make a request pursuant to the CCPA on your behalf upon our verification of the agent’s identity and our receipt of a copy of valid power of attorney given to your authorized agent pursuant to California Probate Code Sections 4000-4465. If you have not provided your agent with such a power of attorney, you must provide your agent with written and signed permission to exercise your CCPA rights on your behalf, provide the information we request to verify your identity, and provide us with written confirmation that you have given the authorized agent permission to submit the request.
Methods for submitting requests under CCPA
Identity verification
We will need to verify your identity to process your information, access and deletion requests and reserve the right to confirm your California residency. Authentication into your online account with us (if applicable), government identification, declarations under penalty of perjury or other information may be required. We cannot process your request if you do not provide us with sufficient detail to allow us to understand and respond to it.
Shine the Light
It is our policy not to disclose personal information (as defined in California’s Shine the Light Law, California Civil Code Section 1798.83) provided to us by our customers (as defined in the Shine the Light Law) to third parties for their direct marketing purposes if the customer has exercised an option that prevents that information from being disclosed to third parties for those purposes. Such customers may exercise this option by submitting a CCPA opt-out request here.

Identity and Location Verification
To help the government fight funding of terrorism and money laundering activities, Federal law requires all financial institutions to obtain, verify, and record information that identifies each person who opens an account. As a result, under our customer identification program, we must ask for your name, street address, mailing address, date of birth, and other information that will allow us to identify you. We may also collect and consider information about you from non-credit reporting agency data providers, including, for example, information about your location and the location of your mobile devices, and publicly available information about you. You acknowledge that by clicking “Check Your Rate”, “Get Approved Today”, “Get QUOTE” and continuing with the application process, you understand and consent to CRESTICO and/or third party service provider(s) (including your mobile phone carrier) to use geolocation services to verify the location of your mobile device.
